IMPORTANT NOTICE: Please read carefully. These Official Rules contain a binding arbitration provision and a class action waiver. All entrants waive the right to resolve disputes in a court of law or before a judge or jury and agree to bring claims only in an individual capacity, not as a plaintiff or class member in any pursuant class or representative action.

PROMOTION DESCRIPTION:

The Bermuda National Rum Day Giveaway (“Sweepstakes”) begins on Thursday, August 13, 2026 at 12:01 a.m. Eastern Time (“ET”) and ends on Wednesday, August 19, 2026 at 11:59 p.m. ET.

The Sponsor of this Sweepstakes is Bermuda Tourism Authority (“Sponsor”).

This Sweepstakes is subject to all applicable federal, state and local laws and regulations and is void where prohibited or restricted by law.

By participating in the Sweepstakes, you unconditionally accept and agree to comply with and abide by these official rules (“Official Rules”) and the decisions of Sponsor, which shall be final and binding in all respects. Sponsor is responsible for the overall administration of the Sweepstakes. Questions, comments, or concerns related to the Sweepstakes should be directed to Sponsor at [email protected].

ELIGIBILITY:

The Sweepstakes is open only to legal residents of Canada (excluding the Province of Quebec) (the “Eligible Territory”) who are eighteen (18) years of age (except in the case of residents of jurisdictions where the legal age of majority is greater than eighteen (18) years, such legal age of majority) or older at the time of entry. The Sponsor, BermudAir Holidays, Grotto Bay Beach Resort & Spa, Fever Pitch Communications, and each of their respective parents, subsidiaries, affiliates, distributors, retailers, sales representatives, advertising and promotion agencies and each of their respective officers, directors and employees, are ineligible to enter or win the Sweepstakes. Household Members and Immediate Family Members of such individuals are also not eligible to enter or win. “Household Members” shall mean those people who share the same residence at least three months a year. “Immediate Family Members” shall mean parents, stepparents, legal guardians, children, stepchildren, siblings, stepsiblings, or spouses. In the event that a dispute regarding the identity of an Entrant or potential winner (each a “Winner,” and collectively, “Winners”) cannot be resolved to Sponsor’s satisfaction, the affected entry will be deemed ineligible. Entries will not be acknowledged except as provided herein.

PRIZE:

Airfare and hotel accommodations will be arranged and fulfilled by BermudAir Holidays. Sponsor is not responsibility for the availability, scheduling, fulfillment, or delivery of travel arrangements, all of BermudAir Holidays.

The total Approximate Retail Value (“ARV”) of the prize is approximately CAD$4,000. The actual retail value of the prize will depend on fluctuating airfares and hotel rates at the time of booking. If the actual value of the prize is less than the stated ARV, the difference will not be awarded in cash, credit, or otherwise.

Limit one (1) prize per Entrant and per household. Prizes cannot be transferred, redeemed for cash, or substituted by Winner. If a prize cannot be awarded due to circumstances beyond the control of Sponsor, a substitute prize of equal or greater retail value may be awarded, in Sponsor’s sole discretion. If Winner cannot accept a prize, or any portion thereof, as stated, the prize may be forfeited at the sole discretion of Sponsor. The value of each prize listed above represents Sponsor’s good faith determination of the maximum retail value thereof. That determination is final and binding and cannot be appealed. If the actual value of the prize turns out to be less than the stated ARV, the difference will not be awarded in cash. Sponsor makes no representation or warranty concerning the appearance, safety, or performance of any prize awarded. Sponsor will not replace any lost or stolen prize items. No refunds or credit for changes are allowed.

PRIZE CONDITIONS: 

All prize details shall be determined in the sole and absolute discretion of Sponsor. Winner is fully responsible for any and all applicable taxes (including income and withholding taxes). Winner is responsible for all expenses not specifically mentioned in the prize description, including, but not limited to, transportation, meals, and gratuities.

The prize must be redeemed by December 17, 2026.

HOW TO ENTER:

Eligible Entrants may enter the Sweepstakes online by following the instructions below.

• Visit the website www.gotobermuda.com/rumday and complete the online entry form for the Sweepstakes, which requests your first name, last name, email address, province and country of residence, and postal code.
• By successfully transmitting a completed online entry form during the Entry Period as directed, you will be entered in the Sweepstakes.

The Sweepstakes Period closes on Wednesday, August 19, 2026 at 11:59 p.m. ET.

Online entrants to the Sweepstakes may be given the option to receive (a) commercial email from Bermuda Tourism Authority and/or BermudAir Holidays; however, eligibility to participate in the Sweepstakes is not dependent upon entrant’s consent to receive such emails and consenting to receive such emails will not impact any entrant’s chances of winning.

Limit of one (1) entry per eligible Entrant. Additional entries beyond the specified limit will be void. If any Entrant exceeds the entry limitations, the Entrant may be disqualified, at the Sponsor’s or Administrator’s discretion. Entries generated by a script, macro, or other automated means will be disqualified. Incomplete, unreadable, or unintelligible entries will be disqualified. All information provided by Entrants becomes the property of Sponsor.

ELIGIBLE ENTRANTS MUST SUBMIT THE REQUESTED ENTRY INFORMATION IN ACCORDANCE WITH THESE OFFICIAL RULES. NO OTHER METHOD OF SUBMISSION WILL BE ACCEPTED.

Participation in the Sweepstakes constitutes Entrant’s understanding of, full and unconditional agreement to, and acceptance of these Official Rules. Sponsor and/or Administrator reserves the right to disqualify any Entrant that are determined to be in violation of any term contained in these Official Rules. Sponsor’s or Administrator’s decision not to enforce a specific provision of these Official Rules does not constitute a waiver of that provision or of the Official Rules generally. Sponsor and Administrator have the right to change the Sweepstakes Period and all other dates or deadlines set in connection with this Sweepstakes in the event of technical, administrative, or other errors beyond the reasonable control of the Sponsor or Administrator, subject to applicable laws.

Sponsor and Administrator are not responsible for any cancellations, delays, diversions, substitutions, acts, or omissions by BermudAir Holidays, Grotto Bay Beach Resort & Spa, or any other persons or entities providing services in connection with this prize. No substitutions, reimbursements, or alternate prize arrangements will be provided.

DRAWING; ODDS:

The Sponsor will be responsible for the collection and processing of entries. On Thursday, August 20, 2026 (“Drawing Date”), one (1) potential Winner will be selected by random drawing from among all eligible Entries received. Odds of winning depend on the total number of eligible entries received. Before claiming the Prize, you will be required to correctly answer a mathematical skill-testing question in order to claim the Prize.

NOTIFICATION:

Before being declared an official Winner, the selected potential winner must first correctly answer, without assistance of any kind (whether mechanical, electronic, or otherwise), a time-limited mathematical skill-testing question to be administered by email or telephone. Failure to correctly answer the skill-testing question within the time specified will result in immediate disqualification.

The potential Winner will be notified at the email address provided at the time of entry (the "Prize Notification"). In the event that any potential Winner does not respond to Prize Notification within three (3) days of the date of issuance or declines the prize for any reason, a disqualification will result, the prize will be forfeited and, at the Bermuda Tourism Authority sole discretion and time permitting, an alternate potential Winner may be randomly selected from among all remaining eligible entries.

Sponsor shall have no responsibility for any failure by a potential Winner to receive, access, or review, or respond to any Prize Notification for any reason, including technical issues, privacy settings, spam filters, or incorrect contact information provided by the Entrant. In the event that any potential Winner does not respond to Prize Notification within three (3) days of the date of issuance or declines the prize for any reason, a disqualification will result, the prize will be forfeited and, at Sponsor’s sole discretion and time permitting, an alternate potential Winner may be randomly selected from among all remaining eligible entries. Unless prohibited by law, the potential Winner may be required to submit his/her valid government-issued photo ID, passport information, national identification, and/or other identification or documentation reasonably requested by the Sponsor. The potential Winner may be required to execute, have notarized, and return an Affidavit of Eligibility and Release of Liability and, unless prohibited by law, a Release of Publicity, within five (5) days of the date of issuance. Failure to submit any identification required by Sponsor or return any required documents within the specified time period, noncompliance with these Official Rules, the return of Prize Notification or of the prize (or any portion thereof) as non-deliverable, may result in the potential Winner’s disqualification and prize forfeiture and, at Sponsor’s sole discretion and time permitting, may cause an alternate potential Winner to be randomly selected from among all remaining eligible entries.

PRIVACY: 

All information submitted online by Entrants is subject to, and will be treated in a manner consistent with the Bermuda Tourism Authority’s Privacy Policy (accessible at https://www.gotobermuda.com/info/terms-use-privacy). Entrants must fully complete and submit all non-optional data requested on the entry form to be eligible. Incomplete and/or inaccurate entries are void. All online entries must include a valid email address for the Entrant.

LIMITATION OF LIABILITY:

Except where prohibited by law (including the Ontario Consumer Protection Act), by entering the Sweepstakes, Entrants agree to release and hold harmless Sponsor, BermudAir Holidays, Grotto Bay Beach Resort & Spa, and Fever Pitch Communications from any and all liability for injuries, losses, damages, or claims arising out of participation in the Sweepstakes or the use of the prize.

Sponsor is not responsible for travel or lodging issues, including but not limited to flight delays, cancellations, overbooking, lost baggage, unavailability of reserved rooms, room category disputes, or any other disruptions, acts, or omissions caused by BermudAirHolidays. Entrants acknowledge that all travel and accommodation logistics are the sole responsibility of BermudAir Holidays, and that Sponsor has no control over and assumes no liability for the acts, errors, omissions, representations, warranties, breaches, or negligence of any such providers, or for any personal injury, death, property damage, or other losses resulting therefrom. Nothing in these Rules shall limit or exclude the Sponsor’s or Administrator’s liability for personal injury or death caused by its gross negligence, willful misconduct, or for any breach of statutory implied warranties that cannot be contractually waived under applicable provincial consumer protection legislation.

ARBITRATION; CLASS ACTION WAIVER: 

As a condition of entering this Sweepstakes, each Entrant agrees that (a) any and all disputes, claims, controversies, or causes of action arising out of or relating to this Sweepstakes or any prizes awarded (each, a "Claim") shall be (i) arbitrated on an individual basis only and shall not be consolidated or joined with or in any arbitration or other proceeding involving a Claim of any other party and (ii) settled by binding arbitration in New York County, New York before a single arbitrator appointed by JAMS in accordance with its then governing rules and procedures, and judgment on the award rendered by the arbitrator may be entered by any court having jurisdiction thereof; and (b) under no circumstance will Entrant be permitted to obtain awards for, and Entrant hereby waives all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses. For New Jersey residents, the limitations set forth above may be inapplicable where attorneys' fees, court costs, or other damages are mandated by statute. These Official Rules shall be governed by and construed and interpreted in accordance with the laws of the State of New York, U.S.A, applicable to contracts entered into and performed exclusively in that State.

PUBLICITY RELEASE:

Unless prohibited by law, the Winner, by acceptance of the prize, grants to Sponsor, the right to publicize his/her name, city and state of residence, prize information, photograph, voice, statements, and/or other likeness for advertising, promotional, trade, and any other purpose, in any media or format now known or hereafter devised, throughout the world, in perpetuity, without limitation and without further compensation, consideration, permission or notification, unless prohibited by law.
